The Supreme Court Monday asked Attorney General Milon Banerjee to be present in court to respond to a petition by four Bihar MLAs challenging the dissolution of the state assembly last month.
The vacation bench of the Supreme Court comprising Justice P.V. Reddy and Justice Arijit Pasayat asked the petitioners' counsel to serve a copy to the attorney general and said the latter could himself appear or he could ask any law officer to be present in court.
The matter will come up for hearing June 10.
The bench Monday observed "that a realignment of political forces does not mean a licence for horse trading".
The petitioners' counsel Mukul Rohatgi said Bihar Governor Buta Singh ought to have explored the possibility of government formation but sent a report recommending dissolution of the House.
The union cabinet met at midnight and approved the dissolution. President A.P.J. Abdul Kalam who was in Moscow signed the proclamation and the house was dissolved May 23.
The move came after two and a half months of president's rule, which has been imposed after elections in February threw up a hung assembly.
